DMCA Policy

Monique Faye Alter respects the intellectual property rights of others and expects users of her website and services to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the "DMCA"), the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, Monique Faye Alter will respond expeditiously to claims of copyright infringement committed using her website or services if such claims are reported to her Designated Copyright Agent identified below.

Filing a DMCA Notice of Infringement

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through our site or services by completing the following DMCA Notice of Alleged Infringement and delivering it to Monique Faye Alter's Designated Copyright Agent.

Upon receipt of a Notice as described below, Monique Faye Alter will take whatever action, in her sole discretion, she deems appropriate, including removal of the challenged content from the site.

Please provide the following information in your DMCA Notice:

  1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest.
  2. A description of the copyrighted work or other intellectual property that you claim has been infringed.
  3. A description of where the material that you claim is infringing is located on the website, with enough detail that Monique Faye Alter may find it on the website (e.g., specific URL).
  4. Your address, telephone number, and email address.
  5. A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner's behalf.

Filing a DMCA Counter-Notification

If you believe that the material you posted on the site was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with Monique Faye Alter by submitting a written notification to her Designated Copyright Agent (see contact link below).

The Counter-Notification must include substantially the following information:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district in which Monique Faye Alter may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
